Louisiana is Looking to Regulate Delta 8 Products

After failing to pass recreational cannabis earlier this year, Louisiana is now looking to regulate Delta 8 through the “Eat Safe Louisiana” initiative. The Louisiana Department of Health told businesses that applications will open for licenses to make cannabinoid infused foods. This “includes the addition of food products containing CBD and delta 8 (THC) products,” the initiative explains. 

With a state approved license, businesses can now make and sell CBD and Delta 8 infused edibles and drinks. These cannabinoids are consumable hemp. The Louisiana state law defines these as “any product derived from industrial hemp that contains any cannabinoids and is intended for consumption or topical use.”

Currently, Louisiana offers a very limited medical cannabis program with only nine dispensaries available for the entire state. 

A Step Forward

As Delta 8 continues to rise in popularity, several states have moved forward with banning the substance, such as North Dakota and Nevada earlier this year. Taking the step to regulate the cannabinoid instead of banning it overall is a step forward advocates are cheering for. By regulating the cannabinoid, research is still accessible. Additionally, consumers can continue to benefit from its non-anxiety inducing experiences. 

Another state to recently start regulating Delta 8 is Michigan. However, unlike Louisiana, Michigan has not started the regulation process. Products are not currently approved for sale. Michigan retailers must wait a longer time to begin to sell delta 8 again in their stores. The state still has rules and regulations to establish.

By continuing to offer the general public access to Delta 8 and regulate it, the hemp industry can continue to grow. Most recently, the FDA and the CDC published opinion pieces about the dangers of Delta 8. However, each organization doesn’t have the authority to make law changes. Banning a substance before understanding it could cause more harm. Delta 8 would then see a similar reaction that cannabis is having with the DEA’s restriction. This has led to years of failed research attempts and fear over the unknown. 

By keeping products available to the public and for researchers will help both the hemp industry and consumers. They will have regulated products which provide better experiences. As more information becomes available, we will update you with the latest.
